Yes — and it's not optional or 'recommended.' From 1 July 2026, every real estate agency in Australia that buys, sells, or assists with property transactions is legally required to comply with Australia's Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws. This is legislation, not industry guidance. AUSTRAC enforces it, and the penalties for non-compliance are severe.

The penalties are serious. For a corporation: up to $27.5 million per breach. For individuals — that means you personally, as a director — criminal charges, not just fines. There's also the risk of licence revocation and your agency being named publicly in an AUSTRAC enforcement action. Being 'almost compliant' is not a defence. The deadline doesn't move.

Not necessarily. Tranche 2 compliance is the legal responsibility of each individual agency — not the head office. Even if your franchise provides tools or templates, you need to ensure your specific agency is enrolled with AUSTRAC, has an AML/CTF Programme in place, and is actively verifying clients from 1 July. Don't assume someone else has handled it — confirm it.

Yes — and this is one of the most common misconceptions. Enrolling with AUSTRAC (deadline: 31 March 2026) registers your agency as a reporting entity. That's step one. Full compliance by 1 July 2026 means you also have an AML/CTF Programme in place, your team is trained, and you're actively verifying client identities on every transaction. Enrolment alone is not enough.
